These Custody & Settlement Services Terms (“Custody & Settlement Terms”) govern the custody, holding, transfer, settlement, and withdrawal of Wallet Assets made available through the Platform.
These Custody & Settlement Terms supplement the PayBito Terms of Service, Privacy Policy, Wallet Services Agreement, Wallet Funding Services Terms, Merchant Payment Authorization Terms, and any other agreements expressly incorporated by reference.
By using the Custody & Settlement Services, the User agrees to these Custody & Settlement Services Terms.
For purposes of these Custody & Settlement Services Terms, capitalized terms not defined herein have the meanings assigned in the Wallet Services Agreement.
“Custody Services” means the services through which Wallet Assets are held, safeguarded, accounted for, administered, or otherwise maintained for Users through the Platform.
“Custody & Settlement Partner” means a bank, trust company, qualified custodian, licensed financial institution, digital asset custodian, settlement institution, blockchain infrastructure provider, or other authorized third-party service provider engaged by PayBito to facilitate Custody Services or Settlement Services.
“Settlement” means the completion of a transfer of Wallet Assets resulting from a Wallet Funding transaction, Merchant Payment, withdrawal, Refund, transfer, or other transaction supported by the Platform.
“Settlement Services” means the services used to complete, reconcile, record, process, or administer Settlement of Wallet Assets through the Platform.
“Withdrawal” means a transfer of Wallet Assets from the User’s Platform Wallet to an external destination supported by the Platform, including a supported blockchain address, financial account, bank account, payment account, or other withdrawal destination approved by the Platform.
“Withdrawal Destination” means the external wallet address, bank account, payment account, blockchain address, financial institution account, or other destination designated by the User for a Withdrawal.
“Settlement Confirmation” means the Platform’s confirmation that Settlement has been completed or recorded in accordance with the applicable Settlement Services.
These Custody & Settlement Services Terms govern the User’s use of the Custody Services and Settlement Services made available through the Platform.
These Custody & Settlement Services Terms apply whenever Wallet Assets are held, maintained, transferred, settled, or withdrawn through the Platform.
These Custody & Settlement Services Terms supplement:
Where a particular Custody Service or Settlement Service is subject to additional terms, those terms supplement these Custody & Settlement Services Terms solely with respect to that service.
Custody Services enable the Platform to maintain records of Wallet Assets, administer Wallet Balances, facilitate Wallet Asset transfers, process Withdrawals, and perform other custody-related functions supported by the Platform.
The availability of any Custody Service may vary depending upon jurisdiction, applicable law, Platform functionality, compliance requirements, Custody & Settlement Partner capabilities, and other operational considerations.
Settlement Services enable the Platform to process, reconcile, record, and complete Settlement of Wallet Assets resulting from transactions supported by the Platform.
Settlement may occur through internal ledger transfers, blockchain transactions, banking systems, financial institutions, or other Settlement mechanisms supported by the Platform.
The User acknowledges that Custody Services and Settlement Services are operational services separate from:
Use of one Platform service does not automatically authorize or initiate another Platform service.
PayBito may utilize one or more Custody & Settlement Partners to provide Custody Services or Settlement Services.
The identity of a Custody & Settlement Partner may change from time to time without amendment of these Custody & Settlement Services Terms.
Nothing in these Custody & Settlement Services Terms creates a contractual relationship between the User and any Custody & Settlement Partner unless expressly provided under a separate agreement.
The Platform may provide Custody Services for Wallet Assets held through the Platform.
Custody Services may include:
Wallet Assets held through the Platform shall be reflected in the User’s Platform Wallet.
The Platform Wallet represents the User’s Wallet Balance as maintained by the Platform and its Custody & Settlement Services.
Custody Services may be performed directly by PayBito, through one or more Custody & Settlement Partners, or through a combination of both.
The User acknowledges that different Wallet Assets, jurisdictions, or services may utilize different Custody & Settlement Partners.
The Platform shall maintain records of the User’s Wallet Balance based upon transactions processed through the Platform.
Wallet Balances may change as a result of:
The User acknowledges that Custody Services may involve one or more custodial arrangements, banking relationships, blockchain infrastructure providers, or other authorized third-party service providers.
Nothing in these Custody & Settlement Services Terms grants the User ownership of any particular wallet address, blockchain address, bank account, omnibus account, settlement account, or other infrastructure used to provide Custody Services.
The Platform may maintain one or more internal ledgers to record Wallet Balances, Wallet Asset movements, Settlement, Withdrawals, adjustments, and other custody-related activity.
The User acknowledges that internal ledger entries may be used to administer Wallet Assets independently of any external blockchain or financial network.
The availability of Wallet Assets for transfer, Settlement, Withdrawal, or other Platform services remains subject to:
Unless expressly stated by the Platform in writing, Wallet Assets maintained through the Custody Services do not earn interest, investment returns, staking rewards, lending income, or other compensation.
Except to the extent required by applicable law or expressly agreed in writing, nothing in these Custody & Settlement Services Terms creates a fiduciary, trustee, investment adviser, brokerage, agency, partnership, or similar relationship between the User and PayBito solely by virtue of the provision of Custody Services.
PayBito provides the technology and operational services necessary to facilitate Custody Services.
Custody Services may rely upon one or more Custody & Settlement Partners, whose identity and operational role may change from time to time without amendment of these Custody & Settlement Services Terms.
The Platform may provide Settlement Services for transactions supported by the Platform.
Settlement Services may include:
Settlement is deemed complete when the applicable Settlement has been recorded by the Platform in accordance with its operational procedures.
The timing of Settlement may vary depending upon:
Settlement may occur using one or more methods supported by the Platform, including:
The Platform may determine the appropriate Settlement method based upon operational, regulatory, technical, or commercial considerations.
Following completion of Settlement, the Platform may provide a Settlement Confirmation containing information including, where applicable:
Settlement may be delayed where reasonably necessary due to:
PayBito does not guarantee Settlement within any specific period.
PayBito may correct Settlement records where reasonably necessary to address:
Where reasonably practicable, such adjustments shall be reflected in the User’s Platform Wallet.
The User acknowledges that Settlement is an operational process supporting transactions conducted through the Platform.
Settlement does not itself constitute:
The Platform may maintain records relating to Settlement for operational, accounting, reconciliation, audit, fraud prevention, compliance, regulatory, security, and legal purposes.
The User acknowledges that Settlement records may be subject to lawful adjustments, corrections, reversals, compliance actions, or other actions permitted under these Custody & Settlement Services Terms, applicable law, or the operational requirements of the applicable Custody & Settlement Partner.
The Platform may permit Users to withdraw Wallet Assets using one or more Withdrawal methods supported by the Platform.
The availability of Withdrawal Services may vary depending upon:
Each Withdrawal requires a separate authorization by the User.
Before submitting a Withdrawal request, the User is responsible for reviewing:
Submission of a Withdrawal request constitutes the User’s authorization to initiate the Withdrawal.
Withdrawals may be made only to Withdrawal Destinations supported by the Platform.
The Platform may require verification of a Withdrawal Destination before processing a Withdrawal.
The User is solely responsible for ensuring that the selected Withdrawal Destination is accurate and capable of receiving the applicable Wallet Asset.
Withdrawal requests shall be processed in accordance with the Platform’s operational procedures.
Processing of a Withdrawal may require:
A Withdrawal may be processed only to the extent the applicable Wallet Assets are available for Withdrawal under the Platform’s operational procedures and Platform Risk Controls.
The Platform may delay, restrict, or decline a Withdrawal where reasonably necessary to:
Where applicable, Withdrawal fees shall be disclosed by the Platform before the User authorizes the Withdrawal.
The User authorizes the Platform to deduct any disclosed Withdrawal fees from the applicable Wallet Assets or otherwise collect such fees in accordance with the Platform’s operational procedures.
A Withdrawal may be delayed or declined due to:
PayBito does not guarantee that any Withdrawal will be completed within a particular period.
Upon completion of a Withdrawal, the Platform may provide a Withdrawal Confirmation containing, where applicable:
The User acknowledges that certain Withdrawals, including blockchain transactions, may become irreversible once processed or transmitted to the applicable network or Custody & Settlement Partner.
The Platform shall have no obligation to recover Wallet Assets transferred to an incorrect Withdrawal Destination resulting from information provided or approved by the User.
The Platform may maintain records relating to Withdrawals for operational, accounting, reconciliation, fraud prevention, compliance, audit, regulatory, security, dispute resolution, and legal purposes.
The User is solely responsible for ensuring that all information submitted in connection with a Withdrawal is complete, accurate, and current.
The User shall carefully review the Withdrawal Destination, Wallet Asset, Withdrawal amount, and all other Withdrawal details before authorizing a Withdrawal.
The User represents and warrants that the User is authorized to use the selected Withdrawal Destination and has the legal authority to receive the applicable Wallet Assets at that destination.
The User agrees to complete any identity verification, authentication, ownership verification, or other verification procedures reasonably requested by PayBito before or during the processing of a Withdrawal.
Failure to satisfy such verification requirements may result in delay, restriction, or cancellation of the Withdrawal.
The User shall use the Custody & Settlement Services solely for lawful purposes and in compliance with:
The User is responsible for maintaining the security of the User’s Platform account, authentication credentials, devices, and access to the Custody & Settlement Services.
The User shall promptly notify PayBito upon becoming aware of unauthorized access, suspected compromise, or any security incident affecting the User’s account.
The User is responsible for maintaining sufficient available Wallet Assets to complete a requested Withdrawal together with any applicable fees.
Submission of a Withdrawal request does not guarantee that sufficient Wallet Assets remain available until the Withdrawal has been processed.
The User shall not:
The User is solely responsible for determining whether to initiate a Withdrawal, selecting the appropriate Withdrawal Destination, and ensuring the accuracy of all Withdrawal instructions.
PayBito does not provide financial, investment, legal, or tax advice in connection with Withdrawals or Settlement Services.
The User agrees to cooperate with reasonable requests made by PayBito relating to Withdrawals, Settlement, Custody Services, compliance reviews, fraud prevention, regulatory inquiries, security investigations, or other lawful operational requirements.
The User remains responsible for all Withdrawal instructions authorized through the User’s Platform account until such Withdrawal has been completed, cancelled, rejected, or otherwise resolved in accordance with these Custody & Settlement Services Terms.
PayBito may utilize one or more Custody & Settlement Partners to provide Custody Services, Settlement Services, Withdrawal Services, or related operational services.
The identity of a Custody & Settlement Partner may vary depending upon the Wallet Asset, jurisdiction, transaction type, regulatory requirements, Platform configuration, or other operational considerations.
Custody & Settlement Partners may perform services including:
Custody & Settlement Partners are independent service providers.
Nothing in these Custody & Settlement Services Terms creates a contractual relationship between the User and any Custody & Settlement Partner except where expressly provided under a separate agreement.
PayBito provides the technology and Platform services necessary to facilitate Custody Services and Settlement Services.
Custody Services and Settlement Services may be performed directly by PayBito, through one or more Custody & Settlement Partners, or through a combination of both.
Except as expressly required by applicable law, PayBito does not assume obligations owed by a Custody & Settlement Partner solely by facilitating Custody & Settlement Services.
A single transaction may involve one or more Custody & Settlement Partners.
The User acknowledges that different portions of a transaction may be performed by different service providers without affecting the validity or enforceability of the transaction.
PayBito may appoint, replace, suspend, or discontinue one or more Custody & Settlement Partners at any time where reasonably necessary for operational, commercial, security, regulatory, legal, or compliance purposes.
Such changes shall not require amendment of these Custody & Settlement Services Terms.
Except where expressly provided by the Platform, the User has no right to designate or require the use of any particular Custody & Settlement Partner.
PayBito may determine the appropriate Custody & Settlement Partner for a particular transaction based upon operational, legal, regulatory, technical, commercial, or risk management considerations.
Certain Custody Services or Settlement Services may be subject to operational procedures, technical requirements, security requirements, or compliance requirements established by the applicable Custody & Settlement Partner.
The User agrees to comply with such requirements where reasonably communicated by the Platform and applicable to the requested service.
The User acknowledges that PayBito applies Platform Risk Controls to protect the integrity, security, compliance, and lawful operation of the Custody & Settlement Services.
Platform Risk Controls may be applied before, during, or after Custody Services, Settlement Services, or Withdrawals.
Where reasonably necessary, PayBito may:
PayBito may require the User to complete identity verification, ownership verification, authentication, security verification, or other verification procedures before permitting Settlement or a Withdrawal.
The User agrees to cooperate with such verification procedures.
Custody Services, Settlement Services, and Withdrawals may be reviewed for purposes including:

PayBito may request additional documentation or information relating to Custody Services, Settlement Services, or Withdrawals where reasonably necessary to:
Failure to provide requested information may result in delays, Withdrawal restrictions, suspension of Custody Services or Settlement Services, cancellation of pending Withdrawals, or other actions permitted under these Custody & Settlement Services Terms.
The User acknowledges that Platform Risk Controls may be modified from time to time in response to:
PayBito may implement such modifications without prior notice where reasonably necessary to protect the Platform or comply with applicable obligations.
PayBito shall administer Platform Risk Controls in good faith and in a commercially reasonable manner consistent with the secure, lawful, and efficient operation of the Custody & Settlement Services.
Nothing in these Custody & Settlement Services Terms requires PayBito to disclose confidential fraud prevention procedures, proprietary security measures, internal risk models, or other confidential information the disclosure of which could reasonably impair the effectiveness of the Platform’s security or compliance programs.
Nothing in this Article limits PayBito’s rights under these Custody & Settlement Services Terms, the Wallet Services Agreement, applicable Platform policies, or applicable law to take any action reasonably necessary to:
PayBito may create and maintain records relating to Custody Services, Settlement Services, Wallet Balances, Wallet Asset movements, Withdrawals, Settlement, internal ledger entries, Platform Risk Controls, and other activities conducted through the Platform.
Such records may be maintained in electronic form.
Platform records may include, where applicable:
The User acknowledges and agrees that electronic records maintained by the Platform may be used for:
To the extent permitted by applicable law, such electronic records shall have the same evidentiary value as other business records.
The User shall promptly notify PayBito upon becoming aware of any material error relating to Custody Services, Settlement, Withdrawals, or Wallet Balances.
Failure to promptly report an apparent error may affect PayBito’s ability to investigate or correct the matter.
PayBito may retain records relating to Custody Services and Settlement Services for the period reasonably necessary to:
Records maintained by the Platform shall be handled in accordance with the PayBito Privacy Policy, applicable law, and reasonable security practices.
Nothing in this Article requires PayBito to disclose confidential fraud prevention procedures, proprietary security measures, internal risk models, or other confidential information protected by law or legitimate business interests.
The provisions of this Article shall survive termination of these Custody & Settlement Services Terms to the extent reasonably necessary to satisfy legal, regulatory, audit, accounting, fraud prevention, dispute resolution, security, or record retention obligations.
PayBito may suspend, restrict, or disable all or part of the Custody & Settlement Services where reasonably necessary to:
During a suspension, PayBito may:
The User may discontinue use of the Custody & Settlement Services at any time by ceasing to use the applicable services or by closing the User’s Platform account in accordance with the applicable agreements governing the Platform.
Termination shall not affect completed Settlement, completed Withdrawals, pending compliance reviews, investigations, record retention obligations, or other rights and obligations arising before termination.
PayBito may terminate the User’s access to the Custody & Settlement Services where:
Termination of these Custody & Settlement Services Terms shall not:
Wallet Assets remaining within the Platform shall continue to be administered in accordance with these Custody & Settlement Services Terms, the Wallet Services Agreement, applicable Platform policies, and applicable law.

The User represents and warrants that:
The User represents and warrants that the Custody & Settlement Services shall be used solely for lawful purposes.
The User shall not use the Custody & Settlement Services in connection with any fraudulent, deceptive, prohibited, or unlawful activity.
The User represents and warrants that the User has the legal right to hold, transfer, settle, or withdraw the Wallet Assets made available through the Platform.
The User shall not use the Custody & Settlement Services in connection with Wallet Assets derived from fraud, theft, money laundering, sanctions violations, or other unlawful activity.
The User represents and warrants that the User’s use of the Custody & Settlement Services complies with all applicable:
The User represents and warrants that all Withdrawal instructions submitted through the Platform accurately reflect the User’s intended Withdrawal Destination, Wallet Asset, Withdrawal amount, and other transaction details.
The User shall review all Withdrawal information before authorizing a Withdrawal.
The User represents and warrants that the User shall not:
The User represents and warrants that reasonable measures shall be maintained to protect the security of the User’s Platform account, authentication credentials, devices, and access to the Custody & Settlement Services.
The User shall promptly notify PayBito upon becoming aware of any unauthorized access, suspected compromise, or security incident affecting the User’s account.
The representations and warranties contained in this Article are continuing in nature and shall remain true throughout the User’s use of the Custody & Settlement Services.
The User shall promptly notify PayBito if any representation or warranty becomes materially inaccurate.
The Custody & Settlement Services are provided to facilitate the custody, holding, transfer, Settlement, and Withdrawal of Wallet Assets through the Platform.
Except as expressly provided in these Custody & Settlement Services Terms or required by applicable law, PayBito does not guarantee uninterrupted availability of the Custody & Settlement Services or any particular Custody & Settlement Partner.
PayBito does not guarantee the continuous availability of any Custody Service, Settlement Service, or Withdrawal Service.
The availability of such services may change due to:
The Custody & Settlement Services may utilize services provided by Custody & Settlement Partners, financial institutions, banks, blockchain infrastructure providers, cloud service providers, telecommunications providers, identity verification providers, compliance service providers, fraud prevention providers, and other third-party service providers.
PayBito shall not be responsible for delays, interruptions, failures, errors, or unavailability resulting from services provided by such third parties.
PayBito does not guarantee that any Settlement or Withdrawal will be:
where such outcome depends upon factors outside PayBito’s reasonable control or the application of Platform Risk Controls.
The User remains solely responsible for:
PayBito shall not be responsible for losses resulting from Withdrawal instructions authorized by the User using inaccurate or incorrect information.
To the maximum extent permitted by applicable law, PayBito shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including loss of profits, loss of revenue, loss of business opportunity, loss of goodwill, loss of data, business interruption, or other commercial losses arising out of or relating to the Custody & Settlement Services or these Custody & Settlement Services Terms.
To the maximum extent permitted by applicable law, the aggregate liability of PayBito arising out of or relating to these Custody & Settlement Services Terms or the Custody & Settlement Services shall not exceed the total fees, if any, paid by the User to PayBito for the applicable Custody & Settlement Services during the three (3) months immediately preceding the event giving rise to the claim.
Nothing in this Article limits liability that cannot lawfully be limited under applicable law.
The User agrees to take commercially reasonable steps to mitigate any loss or damage arising from events relating to the Custody & Settlement Services or these Custody & Settlement Services Terms.
The limitations and exclusions contained in this Article apply regardless of the legal theory asserted, including contract, tort, negligence, strict liability, statutory claims, or otherwise, and survive termination of these Custody & Settlement Services Terms to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, the User shall defend, indemnify, and hold harmless PayBito, its affiliates, officers, directors, employees, agents, contractors, licensors, successors, assigns, and Custody & Settlement Partners from and against any claims, demands, actions, proceedings, damages, liabilities, judgments, settlements, penalties, fines, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
PayBito shall promptly notify the User of any claim for which indemnification is sought, provided that any delay in providing such notice shall not relieve the User of the indemnification obligations except to the extent the User is materially prejudiced by such delay.
The User agrees to cooperate in good faith with PayBito in the defense or resolution of such claim.
The User shall not settle any claim affecting PayBito without PayBito’s prior written consent where such settlement:
The User shall have no obligation to indemnify PayBito to the extent a claim results directly from PayBito’s gross negligence, willful misconduct, or violation of applicable law as finally determined by a court of competent jurisdiction.
The obligations contained in this Article shall survive termination of these Custody & Settlement Services Terms until all applicable claims, proceedings, investigations, liabilities, and indemnification obligations have been finally resolved.
PayBito may amend these Custody & Settlement Services Terms from time to time to reflect changes in applicable law, regulatory requirements, Custody Services, Settlement Services, Withdrawal Services, Platform Risk Controls, security practices, operational procedures, Custody & Settlement Partner requirements, or business operations.
Material amendments shall become effective upon publication on the Platform or by other legally sufficient notice.
The User’s continued use of the Custody & Settlement Services following the effective date of revised Custody & Settlement Services Terms constitutes acceptance of the revised Custody & Settlement Services Terms to the extent permitted by applicable law.
The User may not assign, transfer, delegate, or otherwise dispose of any rights or obligations under these Custody & Settlement Services Terms without the prior written consent of PayBito.
PayBito may assign or transfer its rights and obligations under these Custody & Settlement Services Terms to an affiliate, successor, purchaser, or other entity in connection with a merger, acquisition, corporate reorganization, sale of assets, financing transaction, or other lawful business transaction.
Failure by PayBito to exercise or enforce any right or provision under these Custody & Settlement Services Terms shall not constitute a waiver of such right or provision.
Any waiver shall be effective only if made in writing by an authorized representative of PayBito.
If any provision of these Custody & Settlement Services Terms is held to be invalid, illegal, or unenforceable by a court or other authority of competent jurisdiction, the remaining provisions shall remain in full force and effect to the maximum extent permitted by applicable law.
PayBito shall not be liable for any delay, interruption, failure to perform, or inability to provide the Custody & Settlement Services resulting from events beyond its reasonable control, including:
PayBito shall use commercially reasonable efforts to resume normal operations as soon as reasonably practicable.
The Custody & Settlement Services may utilize Custody & Settlement Partners, financial institutions, banks, blockchain infrastructure providers, cloud service providers, telecommunications providers, identity verification providers, fraud prevention providers, compliance service providers, and other third-party service providers.
Nothing in these Custody & Settlement Services Terms creates a contractual relationship between the User and any such third party unless expressly provided under a separate agreement.
Except as expressly provided by applicable law or a separate written agreement, these Custody & Settlement Services Terms are intended solely for the benefit of the User and PayBito.
Nothing in these Custody & Settlement Services Terms creates rights in favor of any third party.
Headings are provided solely for convenience and shall not affect the interpretation of these Custody & Settlement Services Terms.
Unless the context otherwise requires:
These Custody & Settlement Services Terms are prepared in the English language.
If translated into another language, the English version shall govern to the extent permitted by applicable law in the event of any inconsistency.
The following documents are incorporated into and form part of these Custody & Settlement Services Terms:
These Custody & Settlement Services Terms, together with the documents incorporated by reference, constitute the complete agreement between the User and PayBito relating to the Custody & Settlement Services and supersede all prior discussions, understandings, representations, and agreements relating to the same subject matter.
Questions regarding these Custody & Settlement Services Terms may be directed to PayBito using the contact information published on the Platform.
These Custody & Settlement Services Terms and any dispute, claim, or controversy arising out of or relating to these Custody & Settlement Services Terms or the Custody & Settlement Services shall be governed by and construed in accordance with the laws specified in the PayBito Terms of Service, without regard to conflict of law principles.
Any dispute arising out of or relating to these Custody & Settlement Services Terms or the Custody & Settlement Services shall be resolved in accordance with the dispute resolution procedures specified in the PayBito Terms of Service.
Nothing in these Custody & Settlement Services Terms limits either party’s right to seek temporary, preliminary, or permanent injunctive or equitable relief where necessary to protect intellectual property, confidential information, security interests, or other rights for which monetary damages would be an inadequate remedy.
Unless otherwise required by applicable law or agreed by the parties, the User shall continue to perform obligations under these Custody & Settlement Services Terms during the resolution of any dispute.
The User acknowledges and agrees that acceptance of these Custody & Settlement Services Terms through the Platform constitutes the User’s legally binding electronic acceptance of these Custody & Settlement Services Terms.
The User consents to the creation, maintenance, storage, and use of electronic records relating to:
The User consents to receive notices, disclosures, agreements, amendments, operational communications, compliance requests, security notifications, and other communications electronically through the Platform, email, SMS, API, or other electronic means supported by the Platform.
To the fullest extent permitted by applicable law, electronic acceptances, electronic signatures, click-through acknowledgements, checkboxes, electronic authorizations, and other electronic actions submitted through the Platform shall have the same legal force and effect as handwritten signatures.
PayBito may maintain records of the User’s acceptance of these Custody & Settlement Services Terms, including:
These Custody & Settlement Services Terms become effective upon the earliest of:
These Custody & Settlement Services Terms remain in effect until terminated in accordance with these Custody & Settlement Services Terms, the Wallet Services Agreement, or other applicable agreements governing the Platform.
By using the Custody & Settlement Services, the User acknowledges that the User has read, understood, and agrees to be bound by these Custody & Settlement Services Terms.
The User acknowledges that Custody Services may be provided directly by PayBito, through one or more Custody & Settlement Partners, or through a combination of both.
The identity and number of Custody & Settlement Partners may change from time to time without amendment of these Custody & Settlement Services Terms.
The User acknowledges that Settlement may occur through one or more mechanisms supported by the Platform, including:
The Platform may determine the appropriate Settlement method based upon operational, legal, regulatory, technical, commercial, or risk management considerations.
The User acknowledges that Withdrawals:
The User acknowledges that Custody Services and Settlement Services are operational services separate from:
Use of one Platform service does not automatically authorize or initiate another Platform service.
The User acknowledges that PayBito provides the technology and operational Platform necessary to facilitate Custody Services and Settlement Services.
Except as expressly provided by applicable law or these Custody & Settlement Services Terms, PayBito does not become a bank, qualified custodian, trustee, fiduciary, investment adviser, broker, or financial institution solely by providing the Platform.
The User acknowledges that these Custody & Settlement Services Terms, together with the documents incorporated by reference, establish the contractual framework governing the User’s use of the Custody & Settlement Services.
The User further acknowledges that continued use of the Custody & Settlement Services constitutes continuing acceptance of these Custody & Settlement Services Terms.
