By registering for or using PayBito Teamups, you agree to comply with and be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not access or use the PayBito Teamups platform.
These Terms form a binding agreement between you (the "User," “Influencer,” or “Creator”) and PayBito, its affiliates, and its partners.
2. Description of Service
PayBito Teamups is a platform designed to connect influencers and content creators with brokers who operate using the PayBito platform. Users can create profiles, select content categories, connect social media accounts, and participate in marketing campaigns or promotional collaborations with brokers.
PayBito Teamups may provide tools, resources, and opportunities to help influencers monetize their content or collaborate with PayBito brokers, subject to these Terms.
3. Eligibility
You must be at least 18 years old to register and participate in PayBito Teamups. By registering, you represent and warrant that:
- You are legally able to enter into a binding contract.
- All information you provide is accurate, truthful, and current.
- You will maintain and promptly update your information as necessary.
4. Account Responsibilities
- Your PayBito Teamups account is for your personal use only. You may not share, transfer, or assign your account credentials to any other person or entity.
- You are solely responsible for maintaining the confidentiality of your login information and for any activities that occur under your account.
- You agree to immediately notify PayBito of any unauthorized use of your account or any other breach of security.
5. Use of the Platform
When using PayBito Teamups, you agree to:
- Provide accurate information, including your name, email, date of birth, location, and valid social media handles.
- Select up to five content categories that reflect your expertise.
- Maintain professionalism in all interactions with brokers, PayBito staff, and fellow creators.
- Create content that complies with applicable laws, advertising standards, and platform policies.
- Disclose any sponsored content, paid promotions, or financial relationships as required by law (e.g., using #ad, #sponsored).
You further agree not to:
- Misrepresent your identity, expertise, or affiliations.
- Impersonate PayBito staff or brokers.
- Engage in spamming, fraud, manipulation of engagement metrics, or use of fake followers and bots.
- Upload content that is false, misleading, defamatory, offensive, illegal, or infringes on the intellectual property rights of others.
- Attempt to reverse engineer, hack, or disrupt the platform.
6. Privacy and Data Usage
PayBito Teamups collects and processes personal information, including your email address, date of birth, location, content preferences, and connected social accounts, to facilitate relevant matches between creators and brokers.
By using the platform, you consent to PayBito’s collection, storage, and use of your information as described in the Privacy Policy, which is incorporated by reference into these Terms.
7. Intellectual Property
- All intellectual property related to PayBito Teamups, including logos, branding, text, graphics, software, and design, is the exclusive property of PayBito or its licensors.
- You retain ownership of the original content you create, but grant PayBito and participating brokers a non-exclusive, royalty-free, worldwide license to use, reproduce, share, and display your content for promotional purposes related to PayBito Teamups or broker campaigns.
- You may not use PayBito’s trademarks, logos, or branding without prior written consent, except for materials provided for official campaigns.
8. Payment and Compensation
- Any payments, rewards, or compensation for participation in campaigns are subject to the specific terms agreed upon between you and the broker.
- PayBito is not a party to the payment terms between influencers and brokers unless explicitly stated.
- PayBito is not responsible for disputes regarding payment, deliverables, or campaign expectations between users and brokers.
9. Termination of Access
PayBito reserves the right, at its sole discretion, to suspend or terminate your access to the platform if:
- You violate these Terms or the Community Guidelines.
- You engage in fraudulent, abusive, or illegal activities.
- You misuse the platform in ways that harm PayBito, brokers, or the community.
Upon termination, your right to use the platform ceases immediately. PayBito may remove your profile, content, and access privileges without notice.
10. Disclaimers
- PayBito Teamups provides the platform “as is” and “as available” without warranties of any kind, either express or implied.
- PayBito does not guarantee the success of any collaboration, the availability of campaigns, or the accuracy of broker information.
- PayBito is not responsible for the content created by users or third parties. All collaborations are at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law, PayBito shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of PayBito Teamups.
PayBito’s total liability for any claim related to these Terms shall not exceed the amount you have paid (if any) for using PayBito Teamups within the six months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless PayBito, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the platform, or any infringement of rights.
13. Modifications to Terms
PayBito reserves the right to modify these Terms at any time without prior notice. Changes will be effective upon posting. Your continued use of PayBito Teamups constitutes acceptance of the updated Terms.
14. Governing Law and Arbitration
Licensee and us agree to arbitrate any dispute arising from these Terms or your use of the Services, except for disputes in which either party seeks equitable and other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets or patents. ARBITRATION PREVENTS YOU FROM SUING IN COURT OR FROM HAVING A JURY TRIAL.
